City Sound Guide ("the Service") is operated by Mercer M Aplin ("we", "us", "our"). These Terms & Conditions form the agreement between you and Mercer M Aplin when you access or subscribe to the Service. If you are accepting on behalf of an organization, you confirm you have authority to bind it; if you are accepting as an individual, you confirm you are of legal age to enter a contract.
1. Acceptance
By creating an account, subscribing, or continuing to use the Service, you agree to these terms. If you do not agree, stop using the Service.
2. What the Service provides
City Sound Guide aggregates publicly published municipal code and venue-published production information — noise limits, quiet hours, permit thresholds, curfews and venue-specific rules — into a searchable index, along with a tour planner, printable advance packets, an AI-assisted live lookup for uncatalogued cities, and a user-contributed venue notes forum.
Not legal advice. Every record is a research aid compiled from third-party sources and may be incomplete, outdated, or inaccurate. AI-assisted lookups and unverified records are clearly marked and may contain errors. You are responsible for confirming any rule directly with the issuing municipality or venue before relying on it for a permit application, contract, or production decision.
3. Your account
You must provide accurate registration information and keep it current. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Tell us promptly if you suspect unauthorized use.
4. Licence and restrictions
We grant you a limited, non-exclusive, non-transferable right to use the Service for your own production work within the plan you have selected. You may not resell, redistribute, sublicense, or bulk-export the database; reverse engineer the Service; or circumvent technical limits, paywalls, or rate limits.
5. Acceptable use
You must not misuse the Service. In particular, you must not:
- use the Service for any unlawful purpose;
- commit fraud, send spam, or impersonate others;
- infringe anyone's intellectual property or privacy rights;
- interfere with the security or integrity of the Service, including introducing malware, probing or scanning, or scraping data at scale;
- post defamatory, harassing, or knowingly false content in venue notes or error flags.
6. User content and corrections
Venue notes, error flags, and city requests you submit remain yours. You grant us a worldwide, royalty-free licence to host, store, reproduce, and display that content solely to operate and improve the Service. You confirm you have the right to submit it and that any cited source is accurate. We may review, edit, decline, or remove submitted content at our discretion, and corrections are only published permanently after review.
7. Intellectual property
We retain all rights in the Service, including its software, database compilation and structure, editorial summaries, branding, and documentation. Underlying municipal code is public record; our compilation, curation, and presentation of it are not.
8. Service level
The Service is provided on an "as available" basis. We do not guarantee uninterrupted, timely, secure, or error-free operation, or that any particular city or venue will be covered. Coverage, features, and data change over time.
9. Payment, subscriptions and cancellation
Subscriptions are offered at $2.99 per month or $29.99 per year and renew automatically until cancelled. You can cancel at any time; access continues to the end of the paid period and is not prorated. Payment, billing, currency, tax, invoicing, cancellation and refund mechanics are handled by Paddle and governed by the Paddle Buyer Terms. See also our Refund Policy.
10. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
11. Suspension and termination
We may suspend or terminate your access for material breach of these terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may close your account at any time. On termination your subscription entitlements end; you may export or print your saved tour data before closing, and remaining personal data is handled as described in the Privacy Notice.
12. Warranties and liability
To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, consequential, or special damages, including lost profits, lost bookings, fines, shutdowns, lost data, or loss of goodwill. Our aggregate liability is limited to the fees you paid in the twelve months before the claim. Nothing excludes liability for fraud, death, or personal injury where the law does not allow it.
13. Indemnity
You will indemnify us against claims arising from your content, your unlawful or unauthorized use of the Service, or your breach of these terms.
14. Changes to these terms
We may update these terms as the Service evolves. Material changes will be reflected in the "last updated" date above, and continued use after that date constitutes acceptance.
15. General
These terms are governed by the laws of the State of Indiana, United States, and disputes will be heard in the state or federal courts located there. You may not assign this agreement without our consent; we may assign it in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. If a provision is unenforceable, the rest remains in effect.
